The Draft Prevention of Illegal Eviction from and Unlawful Occupation of Land Amendment Bill, 2026 has been published for public comment in Government Gazette No. 54526 dated 16 April 2026 .

Key implications for agricultural landowners

• ·      The Bill introduces stricter regulation of unlawful occupation, including new offences for organising or facilitating land invasions, with significant penalties.
• ·       It strengthens eviction procedures, requiring mandatory notice to, and joinder of, municipalities and provincial departments in proceedings.
• ·       Courts are required to place greater emphasis on alternative accommodation, which may affect the timing and enforceability of eviction orders.
• ·       Additional provisions allow courts to order compensation for improvements or crops, and introduce mandatory mediation in certain cases.
