NOTICE FOR THE REGISTRATION OF EXISTING DAMS WITH A SAFETY RISK IN TERMS OF THE NATIONAL WATER ACT, 1998 (ACT 36 OF 1998)

The notice calls on owners of existing unregistered dams with a safety risk in terms of section 120 of the Act and the schedule contained in the notice to register their dam(s) at the Dept within 60 days of the publication of the notice and for owners of existing registered dams to confirm their details.

In effect, it says that:

  • All dams meeting the ‘threshold’ for having a safety risk are required to verify the dam’s registration status with the Dept and should be completed by anyone who owns or rents the property in question.
  • If the dam is registered, then:
    • The contact details must be updated
    • This is also applicable to dams where there has been a change of ownership.
  • If the dam is not registered in terms of section 120 of the NWA:
    • Owner must submit registration and classification forms
      • DW692E – application for the classification of a new dam or enlargement or alternation of an existing dam.
      • DW693E – Registration of an existing dam.

      • All forms, classification and registration must be submitted by 21 January 2025
      • Definition of a dam with a safety risk is as follows:
        • Volume greater than 50 000m3 and has a height of 5m or more measured vertically between the lowest downstream ground elevation of the wall and the non-overspill crest level or the general top level of the dam wall.
      • Costs:
        • There is no charge for registration of a dam with a safety risk.
          • If the dam does not appear on the register, the dam will need to be classified first by the department.
