Draft Reviewed Code of Good Practice on the Preparation and Implementation of Employment Equity Plans are published for comment.

Legal challenges to the Employment Equity Amendment Act and the employment equity sector numerical targets remain pending. However, the Amendment Act and the sectoral employment equity framework remain legally operative unless and until they are reviewed and set aside, or their operation is suspended, by a court of law. At present, no court order has suspended or set aside these measures.

Key points identified focuses particularly on ensuring that the Draft Code: does not permit numerical targets to operate as rigid quotas or demographic ceilings;preserves appropriate and reasonable grounds for the non-achievement of numerical targets; andadequately accommodates workplace-specific circumstances, operational requirements and the practical realities of agricultural employers.
